Introduction to the Terms of Use
Our online store welcomes you and informs you that below you will find the terms and conditions governing your use of this store, together with all the legal effects arising from your use of the store's services over the internet through this electronic platform. Any person's use of the store — whether as a consumer of a service or of a product of the store or otherwise — constitutes that person's consent and acceptance, in full legal capacity as recognised under Sharia, regulation and law, of all the articles and provisions of this agreement, and confirms your commitment to its rules and to what is stated therein. This agreement applies to all types of dealings between the consumer and the store. This agreement is deemed effective and in force as soon as you accept it and begin registering with the store, pursuant to Article Ten of the Saudi Electronic Transactions Law.
Article One — Introduction and Definitions
The preamble above is an integral part of this agreement. Below are the meanings and definitions of the principal terms used in this agreement:
1- (The Store) This definition includes every form of the store on the internet, whether an electronic application, a website on the internet, or a physical commercial outlet.
2- (The Consumer) The person who engages in electronic commerce seeking to obtain the products or services the store provides through its electronic platform.
3- (The Agreement) This term means the terms and conditions of this agreement, which govern and regulate the relationship between the parties to this agreement.
Article Two — The Consumer's Legal Capacity
1- The consumer acknowledges that they have the legal capacity recognised under Sharia and regulation to deal with the store, or that they are not less than eighteen years of age.
2- The consumer agrees that, in the event of a breach of this article, they shall bear the consequences of that breach towards third parties.
Article Three — Nature of the Obligation
1- The store's obligation towards consumers is to provide (the service or the product).
2- The store may provide other services, such as after-sales services or other related services, depending on the nature and type of (the service or the product) requested by the consumer.
Article Four — Rules of Use
1- The consumer undertakes to use the store's electronic platform in a manner consistent with public morals and with the regulations in force in the Kingdom of Saudi Arabia.
2- When purchasing a service or product from this store, the consumer undertakes not to use that service or product in a manner that contravenes public morals or the regulations in force in the Kingdom of Saudi Arabia.
Article Five — Accounts and Registration Obligations
As soon as you apply to join this store as a member and user, you are obliged to disclose certain information and to choose a username and a confidential password for use when accessing the store's services. In doing so, you have agreed to the following:
1- That you are responsible for maintaining the confidentiality of your account information and of your password, and that you accordingly agree to notify this store immediately of any unauthorised use of your account information with the store, or any other breach of your confidential information.
2- The store shall under no circumstances be liable for any loss that may befall you, directly or indirectly, morally or materially, as a result of the disclosure of the consumer's username or password.
3- You undertake to use your account or membership with the store yourself, as you are fully responsible for it; if another person uses it, this is presumptive evidence that you have authorised them to use the store in your name and on your account.
4- You undertake to use the store in all seriousness and good faith.
5- You undertake to disclose true, correct, current, complete and lawful information about yourself as required during registration with the store, and you undertake to update your data when it changes in fact or when the need arises.
6- Our store undertakes to treat your personal information and contact details in strict confidence.
7- If it becomes apparent to the store that you have disclosed information that is untrue, incorrect, not current, incomplete, unlawful, or contrary to what is stated in the terms of use, the store has the right to suspend, freeze or cancel your membership, your store and your account on the platform, without prejudice to the store's other rights and its lawful means of recovering its rights and protecting the remaining consumers.
8- In the event of non-compliance with any of the above, the store's management has the right to suspend or cancel your store, your membership, or to bar you from accessing the store's services again.
Article Six — Electronic Communications and Official Channels
1- The parties to this agreement agree that communication shall take place through the email address registered on the platform.
2- The consumer agrees that all agreements, notices, statements and other communications provided electronically stand in place of their written equivalents and constitute evidence in their own right in satisfying regulatory and Sharia requirements.
3- The consumer agrees that they may be contacted and notified of any provisions concerning this agreement, or concerning dealings with them, through the store's management broadcasting general messages sent to all consumers or to specific users of the store.
Article Seven — Amendments to the Terms of Use and Fees
1- If any article or clause contained in this agreement is cancelled, or if any article or clause contained in this agreement is no longer in force, this shall not invalidate the remaining articles, clauses, rules and provisions contained in this agreement, which remain in force until further notice from the store's management.
2- This agreement — as amended from time to time as circumstances require — constitutes the mechanism of work, understanding and agreement between (the consumer) and (the store).
3- The store may impose fees on some consumers, depending on the offers, products or services they request, or on the fees or taxes imposed by the State on the nature of the product or service.
4- The store reserves the right to add, increase, reduce or discount any fees or costs under the articles, clauses and provisions of the terms of use, on any of the consumers, whatever the reason for their registration.
Article Eight — Payment and Settlement Services
1- The store, through its partners, provides the payment and settlement system in the store; this may be carried out entirely online through the payment options available on the store, or through any payment method the store provides from time to time.
2- The store undertakes to set the price of the service or product it displays in its store in accordance with the customary market value.
3- The store undertakes to provide invoices, receipt vouchers and delivery vouchers for all amounts and profits arising in its store, and undertakes to give the consumer their purchase invoice for a service or product.
4- The store undertakes to provide the customary accounting specifications in its electronic store, in application of the provisions of this agreement and in view of the legal, economic, commercial and regulatory interests served by this arrangement.
Article Nine — Intellectual Property
1- The intellectual property rights of the store are owned outright by the store, whether they were owned by it before the establishment of this electronic platform or after its establishment.
2- The consumer shall respect the intellectual property rights of the store, including the name of the store itself and the words, logos and other marks belonging to the store or displayed on it, as every right associated with the store's name is owned in full intellectual property by the store.
Article Ten — Liability of the Store
1- The store undertakes to conduct its commercial activity through this electronic platform in a lawful manner, in accordance with the regulations in force in the Kingdom of Saudi Arabia and with the provisions of this agreement.
2- The store bears no claims arising from errors or negligence, whether resulting directly, indirectly or incidentally, or through the consumer, or through a third party such as shipping companies.
3- The store, its staff, its owners and their representatives undertake that (the product or the service) shall be sound, lawful and authorised under the laws and regulations of the Kingdom of Saudi Arabia, and that it is used for lawful purposes.
Article Eleven — Restriction of Access or Membership
The store may suspend or cancel a consumer's membership, or restrict a consumer's access to the platform's services, at any time, without notice, for any reason, and without limitation.
Article Twelve — Governing Law
These terms of use are governed by and drafted in accordance with the laws, regulations and legislation in force and applicable in the Kingdom of Saudi Arabia, and are fully and wholly subject to the regulations in force with the authorities in the Kingdom of Saudi Arabia.
Article Thirteen — General Provisions
If any article or clause contained in these terms of use is cancelled, or if any article or clause contained in the terms of use is no longer in force, this shall not invalidate the remaining articles, clauses and provisions contained in the terms of use, which remain in force until further notice from the store's management.
These terms of use — which may be amended from time to time as circumstances require — constitute the terms of use and the mechanism of work, understanding, agreement and contracting between the store and the consumer. Both parties to this agreement also agree that the following shall be taken into account:
1- Arabic is the language applicable to the interpretation of the provisions of this agreement, or when it is translated into another language.
2- All prices displayed on the store's services or products may be amended from time to time.
3- Promotional or marketing offers that the store may place are temporary offers; the store has the right to amend these promotional or marketing offers at any time or to discontinue them.
4- The parties to this agreement undertake to deal with one another in a manner that does not contravene Sharia rules and the applicable regulations and laws relating to the nature of the dealings between the store and the consumer.
5- These terms of use may only be cancelled by a decision issued by the store's management.
